By commissioning or working with me, you automatically are agreeing to these Terms of Service whether you have read them or not. Choosing not to read them does not exempt you from them, you do so at your own risk and waive any claims related to misunderstandings or disputes arising from this agreement╚════════♡════════╝

Creator Credit, Ownership & Redistribution

➤ All work, projects, assets, edits, modifications, and other materials created or edited by me, whether provided for free, gifted, personal use, commissioned or commercial, must retain proper creator credit where applicable. This includes crediting both my contributions and any other creators whose work or assets are incorporated into the final project.

➤ My work may not be resold, redistributed, transferred, shared, uploaded, or used for commercial purposes without my prior written permission, regardless of whether the work was paid for or provided free of charge, unless the project was specifically commissioned and agreed upon for commercial use. Unauthorized resale, redistribution, transfer, file sharing, or commercial use constitutes a violation of these terms and may result in an immediate blacklist and permanent refusal of future commissions, services, or assistance.

➤ If I do not own an avatar, asset, clothing, texture, or any other purchased content required for your commission, you are responsible for purchasing and providing it in accordance with the original creator’s Terms of Service. If the asset requires me to personally purchase, commercial license in order to use or access it, you will be responsible for covering that purchase costs.

➤ A valid link to the creator's official store page, along with proof of purchase, is required before any provided files will be used, uploaded or commission completed! You must provide proof of purchase, such as receipts, invoices, or confirmation screenshots, to verify that all assets provided are legally obtained and properly licensed for use. If found that any purchase proof was falsified, you will be held accountable via ban and immediate cancelation of commission with no rights to a refund.

➤ Do not send random, unverified, or suspicious files. If proof of purchase or a legitimate source link cannot be provided, I will have to assume the asset may be stolen, leaked, unauthorized, or otherwise illegitimate and will not be used!

➤ If I purchase any required assets, avatars, clothing, textures, or other content on behalf of your commission, you must provide the necessary confirmation, ownership verification, payment, and required information before any test uploads, files, or project access are provided.

➤ Any assets, clothing, accessories, or other creations made by me during the commission process remains under my ownership unless otherwise discussed and agreed upon. Depending on the type of commission, I reserve the right to reuse, modify, repurpose, or resell any assets I personally create. This primarily applies to standalone assets such as clothing pieces, accessories, and other original creations, but is not limited to those examples. The commissioner does not receive exclusive ownership rights to these creations unless exclusivity is specifically negotiated, agreed upon, and purchased personally. Unless exclusive rights are obtained, I retain the ability to use my own created assets in future personal or commercial projects while still respecting any agreed-upon usage rights and terms.

♡Commission Guidelines♡➤ I primarily accept commissions from returning clients, referrals, friends, and individuals with whom I am comfortable working based on prior interactions or recommendations.

➤ Review of New Requests from individuals outside these groups may still be considered. However, submitting a commission inquiry does not guarantee acceptance, availability, or a response.

➤ Right to Decline I reserve the right to accept or decline any commission for any reason, including my availability, workload, project scope or complexity, communication concerns, prior experiences, personal preferences, or other relevant circumstances. A declined request is not necessarily personal;, it may simply indicate that the project is not the right fit for my services at that time.

➤ I am always willing to learn new tools or methods to help complete a commission. However, if are unable to reach a final decision, we can adjust the project or discuss alternative solutions this may or may not result in a price difference.

➤ I reserve the right to use any work, assets, designs, screenshots, screen sharing, renders, and/or final results produced through my commissions for portfolio, promotional, advertising, and showcase purposes unless a separate Discretion Fee or written agreement states otherwise. This may include posting or displaying the work publicly, including WIPs and completed results, for the purpose of showcasing my skills and services.

➤ I will not claim your character, original design, or intellectual property as my own, redistribute or resell your commissioned avatar/files, or use the commissioned work in-game for personal use beyond necessary testing, presentation, and demonstration of my work. Commissioning me constitutes acknowledgment and acceptance of these portfolio and promotional rights unless otherwise agreed to in writing.

➤ Please maintain professional and respectful communication when interacting with me. Do not engage in excessive friendliness, forced familiarity, or attempts to build a personal relationship solely for the purpose of obtaining assistance, favors, services, advice, or other benefits.

➤ Any help, advice, assistance, discounts, or additional services I choose to provide are offered at my own discretion and should not be treated as an obligation or expectation. Repeatedly requesting favors, indirectly asking for free services (“dry begging”), or only contacting me when you need something is not acceptable.

➤ If I determine that someone is interacting with me primarily for personal gain, I reserve the right to refuse further assistance and/or terminate the associated friendship, commission, or business relationship without obligation to continue. Please respect this boundary to prevent misunderstandings or further issues.

➤ Any textures, edits, files, or avatars provided to you during or after the commission process are your responsibility to test and verify. I may request feedback, confirmation, or that you check the provided files to ensure everything is functioning as intended.

➤ If you fail to test the files, fail to communicate any issues, or do not notify me of a problem within a reasonable timeframe, I cannot be held responsible for delays or issues resulting from the lack of communication. Any known issues should be communicated as soon as possible and followed up on if necessary. Failure to communicate or remind me of an unresolved issue at a later date may be considered a client communication issue and may affect my ability to address or correct the problem.

➤ I am always happy to make adjustments or even restart a project if needed but it must be communicated clearly before the commission is marked complete depending on what has happened their may be a price difference.

➤ After testing the avatar you must provide me a list to look over this includes things Missed, Clipping or improperly edited, I unfortunately tend to overlook things do a good examination.Examples:➤ Tail needs Size increase - details etc

Turnaround Time & Queue
➤ While I do accept Payment Plans, your commission will not be complete until Payment is sent in full. If your commission is paused for any reason and remains incomplete- for the reasons above, responsibility for following up with payment lies with you.

➤ I will make a reasonable effort to remind you and/or myself, but I cannot guarantee reminders or consistent follow-up. I struggle with consistency, staying on top of things, and especially object permanence, which can cause me to lose track of paused or inactive commissions. Please keep track of your commission status and DM me periodically or remind me if needed.

➤Completion time may vary depending on my personal schedule, including work, Mental states and life responsibilities. Because of such, I reserve the right to deviate from predetermined when necessary.

➤ Please understand completion times may vary, because of such, I reserve the right to deviate from predetermined dates when necessary, This also includes personal Downtime, and Breaks. Just because you commissioned me does not mean I will refrain from enjoying my Social life, Personal time, Risk burnt outs for your commission. I have personal issues that lead to losing focus. If you need something changed, fixed, or added write it out clearly in our DMs so I can come back to it and know exactly where I’m going in your project. This helps both of us stay organized.

➤ If you need your commission by a specific date or on a tight schedule, let me know before commissioning this will incur a rush fee.

➤ Larger or more complex projects naturally require more time thank you for your patience.

➤ By proceeding with a commission, you acknowledge and accept this responsibility. Repeated delays, lack of communication, or indefinitely postponing payments, asset purchases, or project progress may result in the commission being paused, your queue position being moved, or the commission being cancelled at my discretion.

➤ Commissions may take anywhere from a few days up to 2–6 months, depending on complexity and current queue size. ➤ I will not do step-by-step beginner hand-holding if direct access is possible i will try to include Video recording included if not request it to avoid future mistakes.
➤ You are required to make an immediate backup of your project before I touch anything. You must Backup your project files or make copies if you failed to do a back up of your project, I will not be liable for negligence on your end.
➤ This service is non-refundable once time has been spent, even if the issue cannot be immediately resolved or requires further investigation. My time and energy are still used.

Refunds may be issued for the following Circumstances➤ I am unable to complete your commission due to personal circumstances.

➤ An accidental or duplicate payment was made.

➤ If 6 months have passed without progress on your commission, unless otherwise agreed upon or delays are caused by the client or me.

Refunds will NOT be issued for the following Circumstances

➤ Work that has already begun, except in the situations listed above.

➤ Completed, delivered, or accepted commissions.
────────────
➤ Changes of mind after work has started.

➤ Requests were not completed to agreed scope of work

➤ Failure to provide required assets, references, files, instructions, or proper information.

➤ Delays caused by the client or lack of communication.

➤ Personal preference changes after work has been completed.
────────────
➤ VRChat, Unity, SDK, game updates, or third-party changes.

➤ Compatibility issues caused by edits or modifications made after delivery.

➤ Failure to read my commission information or Terms of Service.

➤ Being banned, suspended, or otherwise unable to access or use VRChat.

I reserve the right to issue partial refunds at my discretion based on the amount of work completed.

Discretion Fee

➤ The Discretion Fee ranges from 25%–100% of the total commission cost depending on the project's scope, complexity, circumstances, and level of privacy requested. Final pricing is determined at my discretion.

➤Clients may purchase a Discretion Fee if they do not want their commission publicly shared in any form. This fee compensates for the loss of portfolio, promotional, and showcase use of the completed work.With a purchased Discretion Fee, I agree to:➤ Not stream or screen share the project while working on it.

➤ Not post or share any work-in-progress (WIPs), screenshots, renders, videos, previews, or progress updates.

➤ Not publicly showcase the commission on social media, Discord, my portfolio, commission examples, or any other platform.

➤ Not use the commission for promotional purposes or as an example of my work.
────────────
➤ Keep project files and commission details confidential unless required with the client's written permission.Please understand that a Discretion Fee does not transfer ownership or remove my rights/credits as the creator.────────────
➤ You may not claim my work as your own, remove required creator credit, or imply that you created the commissioned work.

➤ My work must still receive proper creator credit where applicable, regardless of whether the project is private, commercial, or personal.

➤ A Discretion Fee only limits my ability to publicly/privately display the commission. It does not remove my ownership rights, change my Terms of Service, or remove crediting,

Rush Fee & Priority Commissions

➤ Rush commissions are available at my discretion but are not recommended, A rush fee may be required when a client requests their commission to be completed ahead of the normal queue or within a shortened deadline.────────────
➤ Rush fees typically range from 25%–50% of the base commission price, depending on the requested deadline, workload, complexity, and current queue. the rush commission may be declined at my discretion. I reserve the right to refuse rush requests depending on my current workload, availability, or the requested turnaround time.

➤ Client delays, missing references, unavailable assets, revisions, or failure to provide required information may affect the agreed deadline. These delays do not qualify for a refund or reduction of the rush fee.

➤Rush fees are non-refundable once work has begun, even if the client later changes their mind or no longer requires the commission by the requested deadline.

➤ Paying a rush fee does not allow the client to skip required commission procedures, revisions limits, payment requirements, or other terms outlined in this TOS.╚════════♡════════╝╔════════♡════════╗
BIG WARNING➤ I reserve the right to refuse any project, style, or request that falls outside my comfort level or guidelines. i will not create, modify, or assist with projects that I do not feel comfortable working on, including but not limited to content that is hyper, feral, exploitative, controversial, hateful, ill-mannered, disturbing, inappropriate, or otherwise goes against my personal boundaries, my Terms of Service, my Client Conduct guidelines, or the rules of the platforms involved. Attempts to hide, misrepresent, or disguise the nature of a request may result in immediate refusal of service, cancellation of the commission, permanent blacklisting, and documentation of the situation for creator safety purposes where appropriate.

➤ My work may not be used displayed distributed modified or incorporated into content that is hateful discriminatory exploitative illegal abusive or otherwise harmful This includes but is not limited to content that promotes ANY illegal activity and violations to Vrchat tos, Unity, blender, I do not accept grey areas regarding a client’s conduct history If I discover that a client has a past or present history is involving conduct that is illegal abusive exploitative hateful discriminatory predatory or otherwise reasonably considered cancelable or harmful I reserve the right to immediately refuse cancel or terminate any commission contract agreement or ongoing service connected to that client This applies regardless of whether the conduct occurred before or after the commission began whether the conduct is directly related to the commissioned work or public information I may rely on said public documented evidence or other information available to me when making this determination.

➤ Any contract agreement commission or service may be considered void or terminated at my discretion if I discover information that materially conflicts with my personal boundaries values reputation brand or Terms of Service.

➤ No client may claim a right to continued service solely because a commission has already been accepted payment has been made or work has begun My work may not be intentionally used in a manner that could reasonably damage misrepresent or negatively associate my reputation or work with hateful discriminatory exploitative illegal abusive or otherwise harmful content. This includes deliberately presenting my work in a context intended to falsely associate me with such content or cause reputational harm.

➤ Violations of these terms may void eligibility for a refund including where work has already been delivered or substantially completed Any refund will be determined in accordance with my Refund Policy and Terms of Service
